1. Informational Purpose Only

ApexLogger provides data, readings, and measurements for informational purposes only. It is not a safety system, warning device, or driver assistance tool. No data displayed by this application should be relied upon to make safety-critical decisions. The application does not provide real-time alerts, alarms, or intervention of any kind. All driving decisions remain solely the responsibility of the vehicle operator.

2. Vehicle Damage

Any damage to your vehicle — including but not limited to mechanical failure, engine damage, drivetrain damage, tire failure, or any other component failure — arising from the use or misuse of this application, or from operating your vehicle in conditions informed by data displayed in this application, is entirely at your own risk. The developer accepts no responsibility and will not be liable for any vehicle damage of any kind.

3. Accidents, Incidents, and Personal Injury

Any accident, collision, incident, personal injury, or property damage occurring during or related to the use of this application is the sole responsibility of the vehicle operator. By using ApexLogger you acknowledge that motorsport and performance driving activities carry inherent risks including serious injury or death, and that you assume all such risks voluntarily.

4. Insurance

You acknowledge and understand that standard personal and commercial vehicle insurance policies typically do not cover damage, injury, or liability arising from off-road driving, track events, autocross events, or other closed-course or sanctioned motorsport activities — whether sanctioned or unsanctioned. It is your sole responsibility to obtain appropriate motorsport or track-day insurance coverage before participating in any such activity. The developer makes no representation regarding your insurance coverage and accepts no liability related to any insurance claim or denial.

5. Litigation and Legal Costs

Any legal action, claim, dispute, or litigation arising from your use of this application — including but not limited to personal injury claims, property damage claims, or third-party claims — is entirely the responsibility of the vehicle operator and application user. All attorney fees, court costs, settlement amounts, judgments, and any other costs related to such litigation shall be borne solely by the vehicle operator and/or application user. The developer shall not be responsible for any such costs.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the developer of ApexLogger shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages whatsoever, including loss of life, personal injury, property damage, loss of data, or financial loss, arising out of or in connection with your use of or inability to use this application.

7. No Warranty

ApexLogger is provided "as is" without warranty of any kind, express or implied. The developer does not warrant that the application will be accurate, error-free, uninterrupted, or fit for any particular purpose. OBD-II data accuracy depends on your vehicle, interface hardware, and connection quality. GPS accuracy is subject to satellite availability and environmental conditions. You should not rely on any reading displayed by this application for safety purposes.

8. Acceptance

Use of the ApexLogger application constitutes your acceptance of these Terms & Conditions in full. If you do not agree, you must discontinue use of the application immediately. The developer reserves the right to update these terms at any time; continued use after an update constitutes acceptance of the revised terms.
